Stone Hill Sport Horse Liability Waiver
EQUINE ACTIVITY RELEASE AND WAIVER OF LIABILITY
WARNING: UNDER PENNSYLVANIA LAW, AN EQUINE PROFESSIONAL AND EQUINE ACTIVITY SPONSOR IS NOT LIABLE FOR AN INJURY TO OR DEATH OF A PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISKS OF EQUINE ACTIVITIES. YOU ASSUME THE RISK OF EQUINE ACTIVITIES PURSUANT TO PENNSYLVANIA LAW.
1. PARTIES RELEASED: In consideration of being permitted to participate in equine activities, I, the undersigned Participant (or Parent/Guardian of Participant), hereby release, waive, and discharge Acacia Perko, James Perko, and Stone Hill Sport Horse, LLC (collectively, the "Released Parties"), including their agents, employees, officers, directors, representatives, and their heirs, successors, and assigns from any and all liability, claims, demands, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my property while participating in such activities.
2. ASSUMPTION OF RISK: I acknowledge that equine activities are inherently dangerous and unpredictable. I understand that horses, regardless of training or past behavior, can act or react unpredictably (e.g., bucking, rearing, biting, bolting, or colliding with objects or other animals) due to sounds, movements, unfamiliar objects, persons, or natural elements. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me as a result of being on the premises or participating in, observing, or handling horses.
3. SCOPE OF ACTIVITIES: This release covers all activities, including but not limited to: riding, training, boarding, grooming, handling, leading, inspecting, or being in the vicinity of equines at any location where the Released Parties conduct business or operations.
4. INDEMNIFICATION AND MEDICAL COSTS: I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including court costs and attorney’s fees, that they may incur due to my participation in these activities. I further agree that should emergency medical treatment be required, I am solely responsible for all costs incurred and that the Released Parties are not responsible for providing or paying for such care.
5. BINDING EFFECT: This Agreement shall be legally binding upon me, my heirs, estate, assigns, and personal representatives. I acknowledge that I have read this document, fully understand its contents, and understand that by signing, I am giving up substantial legal rights. I am signing this agreement voluntarily and without any inducement or duress.
6. GOVERNING LAW: This Agreement shall be construed in accordance with the laws of the Commonwealth of Pennsylvania. If any portion of this document is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
